Appellate Court Justices Empowered Moelter
Appellate Court Justices McDonald, O'Rourke, Huffman, McConnell, and others 'repeatedly concealed critical facts', 'showed callous and shocking disregard' for Damon, and 'empowered the predator'.
The Appellate Court completely disregarded the central fact that the trial court never did an investigation as per Family Code 3118, the law specifically enacted to protect children from sexual abuse. They colluded with the trial court in concealing critical evidence, including the forensic interview and Damon's in chambers testimony. That makes all of their findings, opinions and order of affirmation invalid.
The justices simply regurgitated the fraudulent findings of their colleague (who sits in on the Appellate Court to curry favor), fabricated and distorted facts, and selectively quoted things favorable to Moelter. They did not cite any factual support for Alksne's findings because there is none. |

He wrote this document which shows that Judge Smyth was in excess of jurisdiction by giving custody/visitation to Moelter as he had not complied with the minimum investigation required by Family Code 3118 and had relied on a flawed report by his court-appointed psychologist. Mr. Ducote also wrote the Opening Appellate Brief in the case.

ordered Damon into the full custody of his rapiston June 21, 2012, ignoring his plea for help. Judge Goldsmith is worse than Joe Paterno, et. al., because they "just" looked the other way. She ordered a child into his named molester's full custody and control without any investigation or hearing.

Damon was the first minor to hire his own attorney and file his own motion for protection from his abuser under the new California Law, FC 3042. But Judge Goldsmith deliberately sabotaged Damon's courageous attempt at protecting himself, saying there would be no hearing because there had not been a change of circumstance. This is outright fraud because Damon running away and being in hiding for over a year is undeniably a change of circumstance. Also, the previous judge had already decided there had been a change of circumstance, conducted a hearing and made new orders. Not to mention the new law that allowed Damon to file his own motion and speak for himself.
The next step in the pattern of covering up the sexual abuse when a child does not submit to living with his abuser is to silence him for good by sending him to a camp or boarding school. An insider psychologist like Dr. Barrett will say Damon is defiant or oppositional and Damon will disappear into one of these camps where they will torture him into silence and compliance. See: Help At Any Cost. Damon has made it clear that he will not come back to San Diego to face that fate. The only way to avoid that is for his mother to have some legal custody, which is why they are not giving her any.

Damon's father, Eric Moelter, and his stepmother, Nicole Peill Moelter, tried to send Damon to one of these lock-down 'kid prisons' to torture him into recanting the sexual abuse, but Judge Alksne wanted to try a local psychologist first to keep the $ and control in San Diego.
So she appointed Dr. Breffni Barrett, an insider psychologist experienced in coercing children to recant paternal sexual abuse. Eric paid over $20,000 to Dr. Barrett, and more to the court-appointed therapist, Dr. Craig Carlson, to help him convince the boys that he did not abuse Damon. See: Damon to Camp? and Brainwashing Damon and his brothers The coercive persuasion tactics worked on Damon's brothers, but not on Damon. Nobody could convince him that he did not experience years of sexual assaults. So Judge Alksne declared Damon 'psychologically impaired' (because he still 'believed' his father abused him) and suggested sending him to one of these out-of-state, lock-down facilities where they can use any form of torture to silence kids because they are unregulated. |

Damon's brothers were traumatized and Stockholmed by being deprived of their mom, their primary bond, and anyone who believed Damon, for an extended period of time. The goal is to break the bond with the protective parent so they will be vulnerable. Not surprisingly, they now believe Eric that he didn't really abuse Damon. Siding with the abuser is a survival mechanism, especially when they're forced to be dependent on him, like Damon's brothers were.

Although this loyalty to the abuser allows Damon's brothers to survive and cope, it is very harmful psychologically because it causes a split in the psyche: deep down Damon's brothers know their brother is telling the truth and wish they could help him. They even admit to having to 'compartmentalize' (i.e. split off the truth) encouraged by the very unethical psychologists, Dr. Breffni Barrett and Dr. Craig Carlson. Also, Eric and Nicole have convinced Damon's brothers that their mother is lying, mentally ill and to blame for everything.
What Eric and Nicole are doing to Damon's brothers is serious psychological abuse with lasting consequences, including disruptions in their personality and emotional development. Hopefully someday the boys will know the truth about they did to them and be able to heal from this horrible trauma.
Damon, despite having been sexually abused and having to be in hiding, is actually doing better psychologically than his brothers because he is able to live the truth and not be split or experience the emotional abuse his brothers are enduring. He does not have to live the lies that Eric and Nicole are foisting on his brothers.
