but Judge Lorna Alksne wanted to try a local psychologist, Dr. Breffni Barrett, first.
Dr. Barrett's job was to convince Damon (and his brothers) he hadn't really been abused.

Little facts like those never get in the way of family court judges doing whatever they want.)
Judge Alksne suggested sending Damon out-of-state because those programs

Now that Damon has run away, Eric and Nicole can justify sending him
to one of these camps by saying is that he is 'defiant' or a 'chronic runaway'.

of sexual abuse, improperly ascribing malevolent motives
to mothers attempting to protect their abused children, and then
placing the children in the custody of the fathers who victimized them."

The "malevolent motives" which Mr. Ducote is referring to are versions of pedophile supporter Richard Gardner's Parental Alienation theory.
Gardner's theory contends that vindictive mothers brainwash or coach their children
to report sexual abuse in order to alienate children from the father.
However, statistics show it is very rare for women or children to fabricate abuse.
(Gardner committed a violent suicide after children began suing him for ruining their lives
by causing them to be taken away from loving moms and placed with their molesters.)
Parental Alienation is a completely bogus defense tactic used by child molesters
and colluding family court officials who profit when they side with abusers.
The American Prosecutors Research Institute (a division of the National District
Attorneys Association), identified use of Parental Alienation as
a deliberate means of obstructing prosecution of sexual abuse cases.
Parental Alienation is the number one strategy used to facilitate the cover up of sexual abuse. The judge doesn't need any evidence of alienation, s/he merely appoints
an insider psychologist to opine that mom is alienating.
But it is impossible for Damon's reports of abuse to have been caused
by his mom alienating or coaching him
since Damon's brother, Ryan, was the one who first reported
that their father had come into their room in the middle of the night
and was doing something 'weird' to Damon in his top bunk.
That's what gave Damon the opening to say that his father was abusing him.

Damon's mom was not even the source of the report
and Damon described the abuse in 6 year old language,
so the first judge (Judge Michael Smyth) couldn't say it was alienation.
Instead he said that '6 year olds are stange little creatures who imagine things' (right!)
(BTW--How could Damon have imagined it when it was corroborated by Ryan?)
(But those little facts don't get in the way of judges siding with paternal predators.)
Judge Smyth said that
even if Damon was being molested, he still had to live with Eric
and if Damon's mom didn't cooperate she would "lose her children".
And if she talked to anyone about the abuse she would lose custody as well.
That is incontrovertible proof of the cover up of abuse and silencing of Damon and his mom.

It was only AFTER they came back from hiding that Damon's mom was accused of having "exerted undue influence" (the legal term for coaching and code for alienation)
by Judge Lorna Alksne--with no supporting facts or evidence whatsoever.
If Judge Smyth did not originally find Damon's reports of abuse a result of alienation,
how could Judge Alksne, especially when she did not do a proper investigation,
permit Damon to testify, or even allow a hearing on the abuse?
It doesn't make sense, but then nothing needs to make sense in Family Courts because
family court judges are not held accountable.
As Wendy Murphy, CNN legal analyst, says:
"Family Court judges can do whatever they damn well please."
Judges: First Do No Harm
There is no oversight or accountability and, of course, everybody knows
absolute power corrupts absolutely.
Appellate Courts, which are theoretically supposed to provide oversight,
simply rubber stamp everything the family court judges decide in abuse cases
under the broad discretionary standard.
The San Diego Appellate Court justices did not do a sufficiency of fact review;
they simply regurgitated the fraudulent findings Judge Alksne and Smyth made.
They completely ignored that an investigation as per FC 3118 was never done
making all the findings of insufficient evidence invalid (See: Petition for Rehearing)
The decision was authored by Justice Alex C. MacDonald, who provided no facts or evidence
to support Alksne's ruling that the abuse was a result of
"undue influence" (legal term for brainwashing) by Damon's mom.
They upheld the fraudulent rulings under the too wide discretionary standard,
which is why the San Diego Task Force is trying to get the standard of review
lowered to 'error of law' in child abuse cases.

Notice: It's either blame the child for imagining it or blame the mom for lying/alienating,
but NEVER EVER blame a middle class father with a 'nice' facade. Because then you would have to hold him accountable and 'ruin his reputation'.
Better to let a child be raped for the rest of his/her childhood
than ruin a father's reputation (so says Judge Smyth and countless others).
Way to go archaic Patriarchal Family Courts.
Keep up the good work protecting father predators instead of innocent children.

3/15/12: Damon has been in hiding for going on 9 months.
Damon's father, Eric Moelter, refused to sign a stipulation for joint custody
allowing Damon to be free to live and visit where he wants,
nor would he agree to Damon being emancipated in Alameda.
However, Eric made it very clear that he would agree to him being emancipated in San Diego.
So Damon has decided to go for the emancipation in San Diego.
Damon's attorney has been waiting for over two weeks for Eric to send her the consent form.
Is he going back on his word?
Meanwhile, Damon has filed for joint custody and to be able to live and visit where he wants with a new judge in Family Court, Judge Christine Goldsmith.
At the present time, Damon's mom has zero custody and there is a no contact order.
She was found to be a danger to Damon because she believes him about the abuse,
and, in direct contradiction to that, she was accused of having brainwashed coached Damon
into reporting the abuse by Judge Alksne.
How can someone believe her child was abused AND have coached him?
Makes no sense, but family courts don't need to make sense.
There is no oversight or accountability.
Damon is asking to be allowed to live where he feels safe (with his mom)
and visit his father/abuser when he wants. Imagine that--a 15 year old being allowed to live where he wants. Now why would something as reasonable as that be so difficult to achieve?
Because courts do not do what is in the best interest of children, as is commonly believed.
They do what is in their own best interest politically and financially.
And that is usually to side with the white, middle class sex offender.
Judge Salcido whistleblew and informed the public that judges are told they must
"go along to get along" and dismiss women's and children's reports of abuse.
The status quo is to maintain male entitlement to sexually abuse their kids.
So it is very political. It has nothing to do with protecting children like Damon.
Damon is making history, being one of the first kids (if not the first)
to be able to hire his own attorney and file his own custody motion
to be able to live where he feels safe.

Since Judge Alksne was moved, there is a new judge, Judge Christine Goldsmith.
To her credit, she allowed Damon to have his own attorney, however,
she would not waive mediation. So Damon is supposed to negotiate
with his molester about how much time he should spend with him.
In what other context would a child have to negotiate with his molester?
Can you imagine the boy in the Penn State scandal having to mediate with Sandusky
about how much time and which nights he would sleep over with him?
Of course not!!
These things only happen in family court, which is completely out of touch with reality.
Or should we just acknowledge that it is controlled by abusers and molesters,
who have manipulated the system to maintain control of their victims.
And family court gladly obliges because there is so much financial and political profit to be had.

The Dept. of Justice is coming out with a report soon on this sorry state of affairs
in our so-called "justice" system, inspired in part by Damon's story.
Damon's mom was one of five protective moms presenting their cases at the White House
to DOJ and OVW, along with Amy Lichtenburg, Katy Tagle, Karen Anderson,
and Mildred Muhammed, wife of the D.C. sniper.
In a follow up hearing, eight more protective moms gave testimony
as well as one teen who was forced to live with the abuser.
Amy's and Katy's children are dead after being given to the abuser.
Will Damon end up dead too?
After all Eric threatened to kill him many times if he told about the abuse and Damon is telling.
Additionally, abusers often send children to camps to get them to recant the abuse.
These camps use torture tactics and many kids have even died after a stint in a camp.

Judge Alksne was transferred out of Family Court
to destroy some other poor people's lives.
Or maybe she will actually have to follow the law in civil court,
unlike family court, where she could violate the law with impunity
in her efforts to silence and punish Damon and his mom.
Maybe the new judge will actually listen to Damon
and allow him to live where he feels safe and loved.

Damon applied for emancipation in Alameda County but
Judge Charles Smiley
required Damon to be there in person (instead of over the phone).
Of course, Judge Smiley knew Damon could not be there in person
or they would have arrested him and forced him back to his abuser.
So Judge Smiley ruined Damon's chance to come home and be safe.
Another pro-father, anti-kid judge. What else is new?
Damon's attorney sent a stipulation to Damon's father
asking Eric to agree to Damon being free to live and visit where he wants
so that he can come back to school.

Fathers are permitted to "grow their own victims," as Andrew Vacchs, J.D. put it.
"We cannot stop every case [of child sexual assault], but we can,
as a society, stop providing safe harbor to perpetrators."
Family Court provides safe harbor to perpetrators,
and it is up to us as a society to stop it.
Damon's mom was told by Judge Michael T. Smyth that she must
"act like the abuse did not happen, even if it did"
to preserve the reputation of the Father.
In Family Court, a Father's Reputation is worth more than a Child's Life.
Judge Smyth also threatened Damon's mom that she would lose custody
if she didn't cooperate with the cover up:
"...the only way this family is going to move forward and you’re going to keep these kids is if from here on out, you’re acting like it [the sexual abuse] didn’t happen.
And that’s probably – that’s going to be very difficult for you to do that.
I think that the only way you’re going to be able to do that
is if you know you’re going to lose these kids if you don’t."
A brazen threat on the record made deliberately to intimidate and silence Damon's mom.
What is this--the Dark Ages? Where are we--Afghanistan?
Women in the U.S. still do not have enough power to protect their children.
Judge Lorna Alksne McKellar
and Damon's court appointed attorney, Gary Plavnick confirmed that
Family Court policy is to "reunify" the child with their molester
so there is no need to do a proper investigation or adjudication--
they have to live with their molester anyway!
In what other context are children forced to live with their rapists?
None. Only in Family Court.
Note: Even though women and children are routinely called liars,
they are not really disbelieved--that is a deliberate tactic to justify
separating them from each other, which serves the purpose of silencing them.
The court officials know the abuse is occurring.
They also know their job is to enforce that male entitlement,
that age-old patriarchal dictum, giving the father control of his family
to use and abuse as he wishes (or not, as in the case of a few good men).
Whistleblower Judge Deann Salcido exposed that new judges are told
by their superiors they that they must "go along to get along"
and dismiss women's and children's reports of abuse [or else].
THE COVER UP
Judge Alksne McKellar, Judge Michael T. Smyth, D.A. Bonnie Dumanis,
lawyers, psychologists, CPS workers, and law enforcement have deliberately
colluded in the cover up of sexual abuse by Damon's father, because he,
like Jerry Sandusky, is an "otherwise upstanding" middle class man, with all the privileges that go with that, including sexual access to his own children
and disenfanchised children, as at Sandusky's Second Mile Foundation.

Damon's father, Eric Moelter, refused to sign a stipulation for joint custody
allowing Damon to be free to live and visit where he wants,
nor would he agree to Damon being emancipated in Alameda.
However, Eric made it very clear that he would agree to him being emancipated in San Diego.
So Damon has decided to go for the emancipation in San Diego.
Damon's attorney has been waiting for over two weeks for Eric to send her the consent form.
Is he going back on his word?
Meanwhile, Damon has filed for joint custody and to be able to live and visit where he wants with a new judge in Family Court, Judge Christine Goldsmith.
At the present time, Damon's mom has zero custody and there is a no contact order.
She was found to be a danger to Damon because she believes him about the abuse,
and, in direct contradiction to that, she was accused of having brainwashed coached Damon
into reporting the abuse by Judge Alksne.
How can someone believe her child was abused AND have coached him?
Makes no sense, but family courts don't need to make sense.
There is no oversight or accountability.
Damon is asking to be allowed to live where he feels safe (with his mom)
and visit his father/abuser when he wants. Imagine that--a 15 year old being allowed to live where he wants. Now why would something as reasonable as that be so difficult to achieve?
Because courts do not do what is in the best interest of children, as is commonly believed.
They do what is in their own best interest politically and financially.
And that is usually to side with the white, middle class sex offender.
Judge Salcido whistleblew and informed the public that judges are told they must
"go along to get along" and dismiss women's and children's reports of abuse.
The status quo is to maintain male entitlement to sexually abuse their kids.
So it is very political. It has nothing to do with protecting children like Damon.
Damon is making history, being one of the first kids (if not the first)
to be able to hire his own attorney and file his own custody motion
to be able to live where he feels safe.

Since Judge Alksne was moved, there is a new judge, Judge Christine Goldsmith.
To her credit, she allowed Damon to have his own attorney, however,
she would not waive mediation. So Damon is supposed to negotiate
with his molester about how much time he should spend with him.
In what other context would a child have to negotiate with his molester?
Can you imagine the boy in the Penn State scandal having to mediate with Sandusky
about how much time and which nights he would sleep over with him?
Of course not!!
These things only happen in family court, which is completely out of touch with reality.
Or should we just acknowledge that it is controlled by abusers and molesters,
who have manipulated the system to maintain control of their victims.
And family court gladly obliges because there is so much financial and political profit to be had.

The Dept. of Justice is coming out with a report soon on this sorry state of affairs
in our so-called "justice" system, inspired in part by Damon's story.
Damon's mom was one of five protective moms presenting their cases at the White House
to DOJ and OVW, along with Amy Lichtenburg, Katy Tagle, Karen Anderson,
and Mildred Muhammed, wife of the D.C. sniper.
In a follow up hearing, eight more protective moms gave testimony
as well as one teen who was forced to live with the abuser.
Amy's and Katy's children are dead after being given to the abuser.
Will Damon end up dead too?
After all Eric threatened to kill him many times if he told about the abuse and Damon is telling.
Additionally, abusers often send children to camps to get them to recant the abuse.
These camps use torture tactics and many kids have even died after a stint in a camp.

Damon's mom was told by Judge Michael T. Smyth that she must
"act like the abuse did not happen, even if it did"
to preserve the reputation of the Father.
In Family Court, a Father's Reputation is worth more than a Child's Life.
Judge Smyth also threatened Damon's mom that she would lose custody
if she didn't cooperate with the cover up:
"...the only way this family is going to move forward and you’re going to keep these kids is if from here on out, you’re acting like it [the sexual abuse] didn’t happen.
And that’s probably – that’s going to be very difficult for you to do that.
I think that the only way you’re going to be able to do that
is if you know you’re going to lose these kids if you don’t."
A brazen threat on the record made deliberately to intimidate and silence Damon's mom.
What is this--the Dark Ages? Where are we--Afghanistan?
Women in the U.S. still do not have enough power to protect their children.

and Damon's court appointed attorney, Gary Plavnick confirmed that
Family Court policy is to "reunify" the child with their molester
so there is no need to do a proper investigation or adjudication--
they have to live with their molester anyway!
In what other context are children forced to live with their rapists?
None. Only in Family Court.
Note: Even though women and children are routinely called liars,
they are not really disbelieved--that is a deliberate tactic to justify
separating them from each other, which serves the purpose of silencing them.
The court officials know the abuse is occurring.
They also know their job is to enforce that male entitlement,
that age-old patriarchal dictum, giving the father control of his family
to use and abuse as he wishes (or not, as in the case of a few good men).
Whistleblower Judge Deann Salcido exposed that new judges are told
by their superiors they that they must "go along to get along"
and dismiss women's and children's reports of abuse [or else].

After two years of trying unsuccessfully to protect Damon in San Diego Family Court under Judge Michael Smyth, Damon's mom took his brothers and him into hiding.
After three years in hiding, D.A. Dumanis conducted a review of old documents and found there was enough evidence of sexual abuse
to dismiss all abduction charges against Damon's mom.
Deputy D.A. Teresa Santana said she believed Damon, but did not think there was not enough evidence for "beyond a reasonable doubt" (without having conducted interviews with Damon or any other witnesses), so they could not prosecute Damon's identified molester.
D.A. Dumanis had promised if they came back to San Diego, there would finally be a proper investigation and fair hearing, and Damon would be listened to and protected from his father, Eric Moelter, whom he says sexually and physically abused him for many years and threatened to kill him if he told anyone.
BUT IT WAS JUST A TRICK TO GET THEM BACK TO SAN DIEGO
AND GIVE THE KIDS TO THE MOLESTER.
Dumanis gave the case specifically to her friend, Judge Lorna Alksne McKellar
who deliberately violated laws which were specifically enacted to protect children like Damon.
Judge Alksne did not do the minimum required to investigate the abuse as per FC 3118;
she denied his due process right to an evidentiary hearing and wouldn't allow him to testify;
she denied critical evidence, including the video of Damon describing years of abuse to the Chadwick Center, and the transcript of his in-chambers testimony when he told her about the abuse, in violation of Family Code 7892; and she violated Family Code 3027.5 which prohibits removing custody from parents who report abuse.
INSTEAD OF JUSTICE AND PROTECTION
Judge Alksne used the bogus and inadmissible "Parental Alienation" (PA) theory to take Damon and his brothers away from their protective mom
and place them with his abuser.
[PA theory was created by pedophile Richard Gardner as a disguised way of calling women and children who report sexual abuse liars, silencing them and enabling the switching of custody to the molesters.]
There was not one bit of evidence to support PA, while there was plenty of evidence to support the abuse, but that did not stop Judge Alksne from using it to effectively terminate Damon's mom's parental rights.

"Deprogramming" is pedophile Gardner's recommended cure for Parental Alienation,

A. HOW DO COURT PROFESSIONALS ACCOMPLISH THE COVER UP?
1. POOR INVESTIGATION
A substandard investigation is conducted so that crucial evidence cannot
be gathered.
Insider minors' counsels and psychologists are appointed who spin the data
against the child and mom.
What evidence does get in is deliberately discounted and suppressed which
enables the finding of "insufficient evidence". Although the burden is
supposed to be low (preponderance), no matter how much evidence
there is, there is NEVER ENOUGH to hold a father accountable and 'ruin his
reputation'. Even when there is medical evidence, it is disregarded.
"Insufficient evidence" is deliberately and fraudulently transmuted to:
"No abuse" and mom and kids must "act like it didn't happen" or they will not
see each other unsupervised (where they're not allowed to talk about the abuse.
Even when the abuse is founded and/or the abuser admits to it, it is minimized
and reunification with the abuser is ordered, so the system is designed to give
the children to the abuser no matter what.
2. SHIFT BLAME TO MOM
The blame is shifted to Mom via the Parental Alienation tactic and any of the
myriad of ways women are made to look bad. Mom is portrayed as "mad or bad",
i.e. either she is crazy or vindictive or is not being a "friendly parent".
This takes the focus of the father and puts Mom on the defensive. No credible
evidence is required to make the finding mom is alienating, just the insiders'
bought and biased opinions.
Mom is simply the convenient scapegoat who is destroyed in the cover up.
3. LACK OF DUE PROCESS
A pathetic adjudicative process ensues which is unfair and enables the unsupported
findings that the abuse did not likely happen and mom is guilty of alienation.
Laws and Constitutional rights are violated with impunity--a kangaroo court.
4. THREATS TO SILENCE CHILDREN AND MOMS
Children and mothers who report abuse are told if they do not agree to say the
abuse did not happen or at least stay quiet about it and agree to unsupervised
visitation or joint custody with the abuser, they will not see each other again.
The children are isolated from their mother through supervised visitation

They are sent to complicit insider psychologists who make sure they do not talk
about the abuse. Often the children are brainwashed. [Brainwashing Damon]
5. COVER UP IS COMPLETE
Neither the children nor the mother dare speak of the abuse again for fear of not

The children suffer and are greatly damaged, but the abuser is permitted to do
whatever he wants with HIS children, which is all that matters in family court.

- Open the courtrooms to the public and make judges accountable for their rulings.
- Create designated, specialized DV/Child Abuse Courts where all officials are trained in valid procedures and protocols and are mandated to follow them.
- Get rid of the "best interests of the child" as the standard for custody and replace it with a new concept called the "approximation standard." That means that the judge should try to approximate the same setup for the children that existed before the divorce. If mom was with the kids 70 percent of the time before the divorce, she would be with them 70 percent of the time after the divorce. In non-contested custody cases, the mother and father generally agree to this on their own.
- Most significantly, the allegation of child abuse in a custody battle must be considered a rebuttable presumption, that is, that the sworn testimony of a parent or child claiming abuse is presumed to be true unless and until the accused sufficiently challenges its veracity.

What happened to Freud over 100 years ago helps illustrate
the History and Magnitude of the COVER UP.
When Freud's research led him to the finding that hysteria, an affliction of women, was due to the trauma of having been sexually abused as children, usually by their fathers, he was ostracized, intimidated and threatened by his colleagues and supervisors
with loss of profession, status and income unless he recanted.
After a couple of years, he caved to the pressure of the status quo and made a 180:
He shifted the blame from fathers to children, saying they fantasized, lied, or desired the sex.
He created junk theories to facilitate the cover up--infantile sexuality,
the Oedipal complex and other unscientific garbage.
This pleased his colleagues immensely, so Freud was rewarded with great power and fame.
Freud's colleague, Pierre Janet, never caved to the status quo, and his works were,
although scientifically valid, ignored and forgotten in the cover up.
One student of Freud's, Sandor Ferenczi, did not cave to the status quo either,
insisting Freud was right the first time, and he paid with his life for his courage.

Despite the fact that research shows between 20-25% of children are sexually abused, most of it by fathers and stepfathers, and that
it is rare for children to report abuse falsely or for mothers to fabricate allegations of abuse, Family Court still routinely discredits and blames the mother and/or child, while concealing and transmuting credible evidence of abuse.
One San Diego Family Court judge told a protective mom that in his 30 years on the bench he had never seen a child protected from sexual abuse, so it was not worth her presenting any more evidence (She was attempting to lodge computer evidence of her ex's child porn addiction.) To this day, we have not heard of a child being protected either.
Even if the abuse is substantiated, "reunification" with the abuser begins immediately.
But, of course, there is no reunification with the protective parents who get custody taken away as a result of trying to protect their children. They treat that as a more serious crime than child sexual assault.
Reunification is only for abusers, not loving mothers. The old boys are obviously running this show.
It's time to come out of the Dark Ages and replace the old boys and their minions
with judges who care more about protecting children than the status quo.

Despite the fact that Eric failed the polygraph and the detective placed him on the Child Abuse Central Index
a search warrant was not obtained to get DNA from Damon's sheets (despite Damon saying the abuse in his top bunk bed got him wet) or for Eric's computer (though he was reported to view child porn and have a sex addiction).
The detective said she had more important cases to investigate--meaning outside the family (she mentioned a bus driver)--to bother with getting that or any other evidence which would support filing charges.
This demonstrates the ingrained bias in the criminal justice system against prosecuting family (father) perpetrators.
Andrew Vachss, veteran child advocate says you just have to
"grow your own victim" to get away with child sexual assault.
So, Damon's case was shunted into Family Court where the same bias against believing women and children and holding fathers accountable for sexual abuse exists.The minimum requirements by law (FC 3118) were not followed in gathering evidence about the abuse, and the evidence which already existed was dismissed and concealed. When Damon told a Chadwick Center therapist about the abuse, Damon's minor's counsel, Terry Chucas, would not allow Damon to go back to her and instead made him and his brothers go to "insider" psychologists (Dr. Raymond Murphy and Dr. Jacqueline Gang) who helped cover up the abuse.

Despite the fact that research shows between 20-25% of children are sexually abused, most of it by fathers and stepfathers, and that
it is rare for children to report abuse falsely or for mothers to fabricate allegations of abuse, Family Court still routinely discredits and blames the mother and/or child, while concealing and transmuting credible evidence of abuse.
One San Diego Family Court judge told a protective mom that in his 30 years on the bench he had never seen a child protected from sexual abuse, so it was not worth her presenting any more evidence (She was attempting to lodge computer evidence of her ex's child porn addiction.) To this day, we have not heard of a child being protected either.
Even if the abuse is substantiated, "reunification" with the abuser begins immediately.
But, of course, there is no reunification with the protective parents who get custody taken away as a result of trying to protect their children. They treat that as a more serious crime than child sexual assault.
Reunification is only for abusers, not loving mothers. The old boys are obviously running this show.
It's time to come out of the Dark Ages and replace the old boys and their minions
with judges who care more about protecting children than the status quo.

Despite the fact that Eric failed the polygraph and the detective placed him on the Child Abuse Central Index
a search warrant was not obtained to get DNA from Damon's sheets (despite Damon saying the abuse in his top bunk bed got him wet) or for Eric's computer (though he was reported to view child porn and have a sex addiction).
The detective said she had more important cases to investigate--meaning outside the family (she mentioned a bus driver)--to bother with getting that or any other evidence which would support filing charges.
This demonstrates the ingrained bias in the criminal justice system against prosecuting family (father) perpetrators.

"grow your own victim" to get away with child sexual assault.
So, Damon's case was shunted into Family Court where the same bias against believing women and children and holding fathers accountable for sexual abuse exists.The minimum requirements by law (FC 3118) were not followed in gathering evidence about the abuse, and the evidence which already existed was dismissed and concealed. Damon was deliberately terrorized into compliance by Eric.
Only a sociopathic child predator could do that to a child,
which means that no children are safe around Eric.
Thousands of people have shown their support for Damon through media and email campaigns and petitions, but Judge Alksne still will not listen to or protect Damon. She refuses to do the minimum required by law to gather evidence (Family Code 3118) and is covering up the evidence which already exists, such as the videotape of Damon reporting the abuse to the Chadwick Center and Eric being caught with child pornography.

BRIEF SUMMARY OF CASE [see Damon's Story for more details]:
Damon's mom, Cindy, tried to protect Damon in Family Court for two years before giving up and going into hiding. After three years in hiding, the D.A. reviewed the case and said she believed Damon so she would not prosecute Cindy for abduction. The D.A. and the new presiding judge, Judge Alksne, assured them if they returned to San Diego, Damon would be listened to and protected. So Cindy and the boys returned on February 1, 2008.
BUT IT WAS A TRICK.
Judge Alksne later admitted her only intention had been to get Cindy and the boys back to San Diego so she could give the boys back to Eric. She has dismissed and covered up Damon’s brave, detailed accounts of abuse by Eric and threats to kill him. Alksne appointed minor's counsels and psychologists (court whores) to facilitate her agenda. She has employed cruel and unethical tactics to try and get the boys to go back with their father, including taking them away from their mother and reunification therapy/deprogramming, in which Dr. Breffni Barrett attempted to get the boys to recant the abuse [see page "Reunification Therapy"]. But he was unsuccessful, so he told them they would just have to "forget about it."
The boys have also been court ordered to see a therapist, Dr. Craig Carlson, who has also tried to get Damon to recant the abuse and has covered it up. They are Mandated Reporters so they are breaking the law by not reporting it. Damon's minor's counsel, Gary Plavnick, believes Damon was abused, but says it is court policy to "reunify" him with his abuser. He has not advocated for Damon's right to be protected or to be with his mom.
The boys were told they could not see their mom unless they cooperated with “reunification” with their father—psychological coercion. The boys agreed to cooperate so they could get back with their mother.
BUT THAT WAS A TRICK TOO.
Even though the boys cooperated, they were never allowed to go back with their mom and have been suffering the loss of their life-long primary bond for over two years now. Cindy was told that she could not have custody unless she said the abuse did not happen and stop trying to protect Damon, which she will not do.
Since the boys would not agree to live with their father unless they could also live with their mother, the boys were court ordered against their will to live with him. However, Damon has absolutely refused to be alone with Eric so he is living with guardians while Eric attempts to "groom" him into a false sense of safety and agree to live with him.
But so far Damon has been too smart to fall for the grooming trick, so Judge Alksne has now threatened to ratchet up the torture and send Damon away to a camp to “de-program” (i.e. convince him he was not abused) him. They do cruel things at these camps to convince them to say the abuse did not happen. Judge Alksne told Cindy that she would not get custody of Damon unless she stopped trying to protect him from the abuse. Alksne has used the bogus "parental alienation" theory to justify taking custody away from Cindy. Parental alienation (and all its manifestations--unfriendly parent, danger to the children, coaching, etc.) is a dirty legal defense tactic used by child molesters and corrupt court officials to shift the blame to the protective parent (see the parental alienation page). But Judge Alksne covered all her bases and said that Damon had a great imagination too so maybe that could account for the abuse. Just another version of blaming the victim, which is so much more politically beneficial than holding the perpetrator accountable.
Maybe if Judge Alksne would do what judges are supposed to and have a fair hearing with all relevant and required evidence being allowed in, the truth would come out instead of being covered up.
