Damon, now 13 years old, has been bravely reporting sexual, physical and emotional abuse by his father, Eric, which began at the age of four and went on for many years [see Damon’s declaration], despite threats to kill him and his mom if he told. His mom, Cindy, has been trying to protect Damon in Family court, but instead of listening to Damon and gathering facts and evidence, Judge Alksne is covering up the abuse [see Damon’s Story] and coercing Damon back to his named abuser.
Thousands of people have shown their support for Damon through media and email campaigns and petitions, but Judge Alksne still will not listen to or protect him. She refuses to do the minimum required by law to gather evidence and is dismissing the evidence which already exists. She will not allow a trial or Damon to testify.
Through hers and other judges' cover ups, sex offenders are allowed to walk amongst our children [see Murphy/Parson case where the father molested many of his daughter's friends after Family Court gave him custody and gag ordered the mom]. Statistics show that most sex offenders who abuse family members also prey on children outside the family. Our elected officials must take these cases seriously or all our children are at risk.

Family Court Crisis
News Report
Cindy tried to protect Damon in Family Court for two years before giving up and going into hiding. After three years in hiding, the D.A. reviewed the case and said she believed Damon so she would not prosecute Cindy for abduction. The D.A. and the new presiding judge, Judge Alksne, assured them if they returned to San Diego, Damon would be listened to and protected. So Cindy and the boys returned on February 1, 2008.
BUT IT WAS A TRICK.
Judge Alksne later admitted her only intention had ever been to get Cindy and the boys back to San Diego so she could give the boys back to Eric. She has dismissed and covered up Damon’s brave, detailed accounts of abuse by Eric and threats to kill him. Alksne appointed minor's counsels and psychologists (court whores) to facilitate her agenda. She has employed cruel and unethical tactics to try and get the boys to recant the abuse and go back with their father, including taking them away from their mother and reunification therapy/deprogramming, in which Dr. Breffni Barrett attempted to get the boys to recant the abuse [see page "Reunification Therapy"]. But he was unsuccessful, so he told them they would just have to "forget about it."
The boys have also been court ordered to see a therapist, Dr. Craig Carlson, who has also tried to get Damon to recant the abuse and has covered it up. They are Mandated Reporters so they are breaking the law by not reporting it. Damon's minor's counsel, Gary Plavnick, believes Damon was abused, but says it is court policy to "reunify" him with his abuser. He has not advocated for Damon's right to be protected or to be with his mom.
The boys were told they could not see their mom unless they cooperated with “reunification” with their father—psychological coercion. The boys agreed to cooperate so they could get back with their mother.
BUT THAT WAS A TRICK TOO.
Even though the boys cooperated, they were never allowed to go back with their mom and have been suffering the loss of their life-long primary bond for over two years now. Since they would not agree to live with their father unless they could also live with their mother, the boys were court ordered against their will to live with him. However, Damon has absolutely refused to be alone with Eric so he is living by himself with friends of the child molester, who allow him access whenever he wants.
Judge Alksne has now threatened to ratchet up the torture and send Damon away to a camp to “de-program” him. They do cruel things at these camps to get children to say they were not really abused.
Judge Alksne has used the "parental alienation" theory to justify taking custody away from Cindy. Parental alienation and all its manifestations--unfriendly parent, danger to the children, coaching, etc.--is a dirty legal defense tactic used by child molesters to shift the blame to the protective parent. But Judge Alksne covered all her bases and said that Damon had a great imagination too. Just another version of blaming the victim, which is so much easier than holding the perpetrator accountable.

ON MARCH 9th, JUDGE ALKSNE, ERIC MOELTER, GARY PLAVNIK, DR. BREFFNI BARRETT AND DR. CRAIG CARLSON MAY SEND DAMON AWAY TO A CAMP/BOARDING SCHOOL WHERE HE WILL BE TORTURED INTO SAYING THAT HE WAS NOT SEXUALLY AND PHYSICALLY ABUSED BY ERIC, AND THEY WILL LIKELY THREATEN THAT HE CAN'T LEAVE UNTIL HE AGREES TO LIVE WITH THE PERPETRATOR WHO ABUSED AND THREATENED TO KILL HIM .
JUDGE ALKSNE:
THIS IS NOT NAZI GERMANY!! DAMON HAS THE RIGHT TO HIS THOUGHTS AND BELIEFS AND TO BE SAFE FROM THE MAN WHO HE SAYS ASSAULTED HIM FOR MANY YEARS. STOP TREATING DAMON LIKE A PRISONER OF WAR. IT IS SO WRONG TO ISOLATE HIM FROM HIS MOM AND FRIENDS AND FAMILY IN AN ATTEMPT TO COERCE HIM INTO SAYING SOMETHING WHICH IS POLITICALLY BENEFICIAL TO YOU.
WE ARE FULLY AWARE OF CHILDREN WHO HAVE BEEN TORTURED AND TRAUMATIZED IN THESE CAMPS. SOME OF THEM HAVE FILED LAWSUITS AND WON.
WE ARE WATCHING YOU AND WILL HOLD YOU FULLY ACCOUNTABLE IF YOU SEND THIS STRAIGHT "A" STUDENT TO ONE OF THESE CAMPS THAT ARE SUPPOSED TO BE FOR DISTURBED AND DELINQUENT CHILDREN, NOT FOR KIDS WHO ARE BRAVE ENOUGH TO REPORT ABUSE BY A FATHER.
