DAMON’S STORY
PART I: TRYING TO PROTECT DAMON IN FAMILY COURT—2003-2004
Damon was 6 when he began telling people about how his father, Eric, was sexually abusing him. He probably never would have told because his father had told him it was their “little secret", but his brother, Ryan, happened to wake up one night when his father was getting up into Damon’s top bunk. He told his mother, Cindy, he thought that was “really weird.” Damon then told about Eric abusing him. He also told CPS, a detective and the Chadwick Center, who believed Damon and ordered supervised visits, The police placed Eric on the Child Abuse Central Index. The Domestic Violence Judge, Judge Hightower, also believed Damon and issue a restraining order against Eric.
The problem protecting Damon started when it was transferred to Family Court. Judge Michael Smyth immediately dismissed the CPS and police reports and the restraining order and gave the boys back to Eric unsupervised, without doing the proper investigation as per Family Code 3118. Damon had since said the abuse happened every time he visited Eric at night and that there were lots of other times and places too ever since he was four years old. But Judge Smyth said he did not want to ruin Eric's reputation.
Cindy tried to get Judge Smyth to listen and protect him, to no avail. Cindy took Damon to Chadwick Center again where he reported the abuse to a doctor, but Minor’s Counsel, Terry Chucas, scolded her for that, saying she couldn’t take him back there (despite Chadwick Center wanting him to continue) and threatened Cindy if she continued to try and protect Damon she would lose custody. She was terrified of losing custody and Damon being completely at Eric’s mercy, so she agreed to say there was enough evidence. She hoped Eric would not abuse Damon anymore since he had been caught.
But, the first weekend after the hearing, Damon came home crying, saying that his father had made him sleep with him. Despite Chucas’ threats, Cindy reported it and it was confirmed. Eric could not deny it because Evan and Ryan had witnessed it. After that incident, Damon said Eric would wait until Evan and Ryan were asleep before taking him to bed with him. Cindy asked Judge Smyth for an order prohibiting Eric from sleeping with Damon, but he denied it, unbelievably, saying that a father has a right to sleep with his son (even though Damon was almost 8 and really distressed by it). Apparently, fathers still own their children in family court.
Cindy then hired the nation’s best attorney in protective parent cases, Richard Ducote. He filed a motion to set aside Smyth’s judgment (that there was not a “preponderance of evidence” that Damon was abused) due to the fact that a proper investigation had never been done as per Family Code 3118, which had been enacted specifically to protect children in these cases. The opportunity to appeal, however, would have expired before the motion could be heard and Cindy was advised she would have a better chance with the appeal. An appeal would be extremely expensive and meant Damon would continue to be abused for years more while it was pending.
Damon was still having severe night terrors, nightmares, night sweats and tremors almost every night. Cindy told him that the court would not listen to her, but if he told his teacher about it, maybe they could help. So Damon told his teacher and principal and they called the police. But Chucas followed through on his threat and recommended the boys be taken away from Cindy and full custody be given to Eric. That's when Cindy realized she could never protect Damon in Family Court and went into hiding with them. They left San Diego on November 5, 2004.
PART II: IN HIDING—2004-2008
Cindy and the boys fled far away to upstate New York in November, ‘04. They rented a little apartment and stayed to themselves as much as possible while Cindy homeschooled the boys. One day when the boys were talking about Eric, Damon slumped and his eyes rolled up into his head. They kept asking him what was wrong, but he was unresponsive. Then Damon jumped up and began making strange sounds, screeching, whimpering and whining. He ran all over the apartment trying to hide under chairs, beds, couch cushions, and comforters. He was clearly terrified and they tried to calm him down, but he didn’t seem to hear them. This went on for almost two hours until he collapsed, exhausted. Damon was having a flashback of the abuse and he continued to have flashbacks for more than a year.
After the flashbacks, Damon would talk about the abuse. Each time he would tell more and more about what Eric did to him. Cindy, Evan and Ryan were horrified at all the times and places he told them about. When asked why he didn’t tell them about it before, he said he was afraid because Eric had threatened to kill him, his mother and his hamster if he told anyone.
Damon told about how Eric would come into his room after his brothers were asleep and drag him upstairs to his bed or abuse him in some other room. He told about how Eric would sometimes duct-tape him to the bed and duct-tape his mouth shut so he couldn’t scream out. He told about how Eric would abuse him in the beer room (Eric made beer), the shower, and the closet.
Damon told about Eric taking him outside in the middle of the night and abusing him in the pool where Damon thought he was going to drown. Damon told about how scared he was when Eric would take him to the boys’ fort in the canyon at night and make him lay him in the dirt. He was really scared of wild animals, snakes and insects. He told about how Eric would punish him if he tried to hide from him by locking him outside all night without a blanket where he would freeze and be terrified of wild animals and snakes. Eric’s house bordered a canyon where coyotes and snakes are common.
Damon’s trauma symptoms improved over the three years they were in hiding until he completely stopped having nightmares, flashbacks and anxiety attacks. He still had some anxiety and fears, but was much improved. Cindy decided that she would work with her family on a campaign to be able to come out of hiding so the boys could live a more normal life.
Her family met with lots of people and organizations, gaining the awareness and support of national and state organizations like NOW, Justice for Children, Defenders of Children, California Protective Parents Association, Stop Family Violence, etc. They petitioned the D.A. to review the case and dismiss the abduction charges against Cindy and Family Court to agree to listen to Damon, to do the proper investigation, and most of all to allow Damon to testify to all the abuse he had endured, so that he could be safe from Eric.
D.A. Bonnie Dumanis dismissed the charges and assured Cindy’s family that if they came back to San Diego, the new presiding judge (a friend of hers), Judge Alknse would listen to Damon and give him a fair hearing.
PART III: BACK IN THE CORRUPT FAMILY COURT SYSTEM 2008-present
Judge Alksne had told Cindy and the boys that if they returned to San Diego, she would listen to Damon, take the abuse seriously and do the proper investigation per FC 3118. She said the boys would only have to stay with friends of Eric’s for two weeks while Damon told a psychologist about the abuse. She lied. She later admitted on the record that she had never had any intention of doing a proper investigation or even having a hearing on the abuse. Her only intention had been to give the boys back to their father. Then she and her appointees did what Judge Smyth's court had done--threatened Cindy with loss of custody if she did not stay silent about the abuse and accept Damon living with his identified rapist.
Damon told three psychologists, a social worker at Chadwick Center and his minors’ counsel (who believes him), about the years of abuse, but Judge Alksne went back on her word and ignored all his brave reports. She did not do the 3118 investigation, nor would she allow Damon or his brothers to testify.
Judge Alksne would not allow the children to keep the attorney they had hired who was advocating for them. Instead she appointed three minors’ counsels who would not advocate for what they wanted, a violation of the ABA standards. She appointed psychologists who are known court whores who spin the case whichever way the money and power point. None of them reported the abuse as they are mandated to do, they all simply facilitated Judge Alksne’s stated agenda of “reunification,” i.e. coercing the boys against their will to live with Eric.
The boys endured reunification therapy with Dr. Breffni Barrett who tried unsuccessfully to convince them the abuse did not happen. He eventually gave up and told them they would just have to forget about the abuse so their life could be back to normal, i.e. so they could get back to their mom. So they agreed to forget about it and visit with Eric, but they were never allowed back with their mom, another dirty trick. Dr. Craig Carlson also tried to convince the boys the abuse did not happen, but he could not either.
When Cindy realized that they were about to send the boys back to Eric no matter what, she launched an email campaign with StopFamilyViolence.org. There were over 15,000 emails sent to legislators and judicial officials supporting Damon’s right to protection and justice.
But Cindy had walked right back in the same corrupt system that she had successfully escaped. She had made the huge mistake of trusting Judge Alksne and she and the boys are suffering greatly because of it. They are only allowed a three hour supervised visit with each other once a week. Evan and Ryan have been forced against their will to live with Eric and their stepmother who they can’t stand.
Damon is stuck with the guardians alone because he is refusing to live with Eric. He is still terrified of what Eric will do to him for telling everyone about the abuse and is afraid he will be sexually abused again (he knows there is no cure for child molesters, besides, Eric does not want to be cured). Instead of acknowledging Damon’s terror for what it is, Judge Alksne has threatened to send him to a boarding school/camp to coerce him into recanting the abuse. That way she will be exonerated and so will all her cronies.
But if she does that, the world is watching and she will pay dearly with what is left of her reputation. Someone has already made death threats against her and has trashed her on many internet sites for her handling of Damon’s case and others like it. The FBI is even involved. What next, Judge Alksne?
In July, 2010, despite Damon saying he wanted to live with his mom and was afraid to be alone with his identified molester, Alksne gave full custody to Eric. Cindy was allowed to have unsupervised visitation on the condition she take down her website and stop her protests of the corrupt Family Courts.
Part IV: Full Custody and Control to the Molester, 2011
Damon was very unhappy under the full control of his molester and there were more and more times he was being forced to be alone with him. When he would leave the house whenever left alone with Eric, stepmother Nicole would give him a hard time instead of sympathizing with his fear. She obviously could not care less whether he was abused or about him wanting to be with his real mom. After all, she "inherited" him and is a "better mother" than Cindy as she told her friends. (Funny how Damon would run away if she really were a better mother.)
Damon ran away on July 11, 2011. He has said he won't come back until he can live with his mother. But still Eric, Nicole and Judge Alksne don't care what he wants. After all, he is only 15 years old. They will continue to try and force him under their control with more coercive tactics.
